Les soins de sant\u00e9 sont organis\u00e9s \u00e0 l\u2019\u00e9chelle provinciale et incluent les Commissions d\u2019Examen qui ont un r\u00f4le majeurs en psychiatrie l\u00e9gale. Ces Commissions exercent un r\u00f4le de contr\u00f4le et supervision, par l\u2019interm\u00e9diaire de la prise en charge hospitali\u00e8re, des accus\u00e9s atteints de maladie mentale qui sont non criminellement responsables (NCR) ou inaptes \u00e0 subir leur proc\u00e8s l. La d\u00e9cision de la responsabilit\u00e9 criminelle ou de l\u2019aptitude \u00e0 subir son proc\u00e8s est d\u00e9termin\u00e9e par les tribunaux.  Les \u00e9valuations de la responsabilit\u00e9 criminelle ou de l\u2019aptitude \u00e0 subir un proc\u00e8s sont effectu\u00e9es par un h\u00f4pital m\u00e9dico-l\u00e9gal d\u00e9sign\u00e9 \u00e0 la demande des tribunaux.\n\n\n\nTout en desservant leurs r\u00e9gions respectives, les services de psychiatrie l\u00e9gale d\u00e9sign\u00e9s sont en communication r\u00e9guli\u00e8re pour partager leurs ressources, ce qui r\u00e9duit les temps d\u2019attente et optimise la disponibilit\u00e9 des services m\u00e9dico-l\u00e9gaux de sant\u00e9 sant\u00e9 mentale m\u00e9dico-l\u00e9gale?<\/h2>\nLa sant\u00e9 mentale m\u00e9dico-l\u00e9gale est l\u2019intersection du syst\u00e8me de sant\u00e9 mentale et du syst\u00e8me de justice p\u00e9nale.\n\nAu Canada, une personne ne peut subir un proc\u00e8s criminel que si elle est en mesure de comprendre la nature des proc\u00e9dures intent\u00e9es contre elle, le fonctionnement du tribunal et les cons\u00e9quences judiciaires possibles. Lorsque le tribunal juge qu\u2019une personne ne r\u00e9pond pas \u00e0 ces crit\u00e8res, elle est dite \u00ab inapte \u00e0 subir son proc\u00e8s \u00bb (inapte). \n\nDe m\u00eame, au Canada, une personne ne peut \u00eatre d\u00e9clar\u00e9e coupable d\u2019une infraction criminelle que si, au moment o\u00f9 l\u2019infraction a \u00e9t\u00e9 commise, elle pr\u00e9sentait les crit\u00e8res du mens rea et de l\u2019actus reus, elle avait conscience de la nature de ses actions (ou omissions), et elle savait que son comportement \u00e9tait mauvais. Lorsqu\u2019un tribunal conclut qu\u2019une personne atteinte d\u2019un trouble mental ne r\u00e9pond pas \u00e0 ces crit\u00e8res, le tribunal doit d\u00e9clarer cette personne \u00ab non criminellement responsable pour cause de troubles mentaux \u00bb (NCR). \n\nLe syst\u00e8me m\u00e9dico-l\u00e9gal de sant\u00e9 mentale est le r\u00e9seau de services fournis pour soigner et r\u00e9adapter les personnes atteintes de maladie mentale et dont le comportement a eu une cons\u00e9quence l\u00e9gale. \n\nLorsqu\u2019un accus\u00e9 reconnu non criminellement responsable a fait les progr\u00e8s n\u00e9cessaires dans sa r\u00e9adaptation pour que la Commission d\u2019examen conclue qu\u2019il ne constitue plus une menace importante pour la s\u00e9curit\u00e9 du public, la Commission doit accorder une lib\u00e9ration inconditionnelle. Un accus\u00e9 qui a \u00e9t\u00e9 lib\u00e9r\u00e9 de fa\u00e7on inconditionnelle n\u2019est plus assujetti \u00e0 la surveillance judiciaire ou m\u00e9dico-l\u00e9gale du syst\u00e8me de sant\u00e9
